This Terms of Agreement (“Agreement”) is between you (“You” or “Your”) and ABC Rifle Company (“ABC Rifle Co” or “Company”). In consideration of the right to access and use the Company’s website www.ABCrifle.com (“Website”), and the information offered on the Website, you agree to the terms and conditions of use set forth in this Agreement.

ALL FIREARMS & UPPER ASSEMBLIES  ARE BUILT TO ORDER. PARTS ARE CUSTOM COATED AND ALLOWED TO DRY AND CURE FOR UP TO 5 DAYS BEFORE ASSEMBLY. AFTER ASSEMBLY THEY ARE TEST FIRED , PACKED AND SHIPPED.

PLEASE ALLOW 10-15 BUSINESS DAYS TO SHIP. 

A $100 CANCELLATION FEE WILL BE CHARGED FOR CANCELLED FIREARM/ ASSEMBLED LOWER RECEIVER ORDERS.

A $25 CANCELLATION FEE WILL BE CHARGED FOR CANCELLED NON-FIREARM ORDERS & STRIPPED LOWER RECEIVER ORDERS.

We try our best to accurately describe the items we list on website.  Photos are provided for general illustration purposes and are not intended to provide instructions on the use of the products. We reserve the right to edit or update the picture or description at any time to correct error in product listing.

SHIPPING:

Buyer agrees to inspect all products against shipping papers and for damage or shortage upon receipt of goods; Claim for loss, damage in transit shall be made with carrier. Claims for shortage must be made within five (5) days of receipt.

RETURNS: 

1)  Returning Non-FFL items

At the discretion of ABC Rifle Company, Returns MAY be accepted for Non-FFL items that are DEFECTIVE within 5 days of receipt.  Please contact us at (SALES@ABCRIFLE.COM) for Return Merchandise Authorization(RMA). We may at our discretion send you a return shipping label, provide a refund, or exchange on defective items. 

At the discretion of ABC Rifle Company, Returns may be accepted for Non-FFL items that are the incorrect size, no longer needed, changed mind, etc. within 5 days of receipt. Restocking fee of $25 and or 3% of the purchase price will apply.  Please contact us at (SALES@ABCRIFLE.COM) for Return Merchandise Authorization(RMA).Shipping label will not be provided.  

Products returned without previously obtaining an RMA won’t be accepted and will be returned at sender’s own expense. There are NO REFUNDS on upper and or lower build assemblies, magazines, optics or scopes. All warranty claims on Non-FFL items must be made within 5 days of delivery receipt.  

2)  Returning a firearm

Once a firearm is transferred to you, it is considered used and NO Returns will be accepted.

Background Check Failure : A $100 Restocking Fee PLUS any RETURN shipping fees will be applied and deducted from the amount refunded and In addition to Transfer-In and Restocking fees, you forfeit the Background Check fee and Transfer fee, plus any Sales Tax paid (if applicable) on the original receipt (depending on original shipping location). These will be deducted from the amount refunded as well.

WARRANTY: All firearms are tested fire to ensure functionality before shipment.

Who is covered?
The original PURCHASER (with proof of purchase).

This Limited Warranty covers FUNCTIONAL defects ONLY; it does not include the firearm’s finish, grips, magazines, sights and or accessories etc.

Warranty will cover Any defect in materials or workmanship (performed by ABC Rifle Company) encountered during normal use.
ABC Rifle Company reserves the right to determine what constitutes the unreasonable or excessive use of the firearm.

What is NOT covered?

Personal injury, property damage, and/or damage to the firearm caused by:
Normal wear and tear /rust or corrosion
Blemishes, scratches, and or discoloration in finish
Damage due to Improper maintenance and or negligence to provide proper care and maintenance.
Barrel obstructions.

IMPORTANT NOTE:

ANY UNAUTHORIZED ALTERATION OR MODIFICATION OF THE FIREARM OR USE OF PARTS OR COMPONENTS NOT ORIGINALLY MANUFACTURED AND OR INSTALLED BY ABC RIFLE COMPANY SHALL VOID THIS WARRANTY. ABC RIFLE COMPANY SHALL NOT BE RESPONSIBLE FOR ANY CLAIMS INVOLVING THIS FIREARM THAT RESULT FROM THE USE OF FAULTY, NONSTANDARD, REMANUFACTURED, RELOADED AND OR IMPORTED STEEL CASED AMMUNITION AND THE USE OF SUCH AMMUNITON SHALL ALSO VOID THIS WARRANTY.
ABC Rifle Company will, at it’s sole discretion, repair or replace any firearm manufactured by ABC Rifle Company that fails due to a defect in materials or workmanship. Parts and labor are included. Repairs are warranted for the duration of the warranty. ABC Rifle Company reserves the right to substitute parts needed to complete a warranty request if the model of firearm is no longer offered or parts needed for replacement and or repair are not available. ABC Rifle Company will not be responsible for
Returned Firearms must be packaged securely in an unmarked sturdy box. ABC Rifle Company shall not be held liable for return shipping cost and it is recommended that you send your return using a reliable carrier and a method that can be tracked and insured. We are not responsible for any RETURN packages lost or damaged in transit. All returns must be authorized by ABC Rifle Company and you must be issued a RMA # before returning any part and or firearm. All accessories must be removed from firearm prior to returning and ABC Rifle Company shall not be held liable for damaged and or missing accessories if shipped along with a return firearm. ABC Rifle Co GIVES NO WARRANTIES TO BUYER EXCEPT THOSE EXPRESSLY CONTAINED HEREIN. ABC Rifle Co DISCLAIMS ALL OTHER WARRANTIES IMPLIED BY LAW, USAGE OF THE TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Legal Disclaimer

You are responsible for following all Federal, State and Local laws pertaining to the firearm purchase, transfer, and storage or using firearms.

Federal law requires us to ship your firearm to a gun dealer who holds a valid Federal Firearms License (FFL).

***NOTE: MUST BE 21YRS OLD TO PURCHASE A PISTOL/HANDGUN******NOTE: MUST BE 18YRS OLD TO PURCHASE A RIFLE***

The Locator of Federal Firearms License (FFL) dealer on our website is provided for information only. We are not afflicted with any FFL dealers. You are responsible for verifying the transfer with the FFL before placing orders. The FFL dealer has to send us a copy of valid FFL license along with your name and order number in order for us to process your firearm order. You are responsible for checking your local laws about required documentation to complete the transfer. The firearm transfer is solely between you and the FFL dealer. Customer assumes all responsibility and cost for returned products due to FFL’s refusal or failure to receive.

ABC Rifle Co is pleased to offer suggestions on the use of its various products. However, ABC Rifle Co neither assumes responsibility for any omissions or errors nor assumes liability for any damages that result from the use of its products in accordance with information provided by ABC Rifle Co, either verbal or written.

INDEMNITY AND LIMITATION OF LIABILITY: 

Indemnification.
You agree to indemnify, defend and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any and all third-party claims, liability, damages, and/or costs including, but not limited to, attorneys’ fees arising from Your violation of the terms of this Agreement.

GOVERNING LAW

These terms and conditions contemplated hereby shall be governed by, and construed and interpreted in in accordance with the laws of the State of Nevada. The sole forum for any dispute arising from these terms and conditions shall be shall be in the federal or state courts located in Clark County, Nevada.
